Please read these Terms carefully before using Mosaic Habits. By using the app, you agree to be bound by them.
1) Interpretation and definitions
Words with the initial letter capitalised have meanings defined under the following conditions. These definitions have the same meaning whether they appear in singular or plural. For the purposes of these Terms:
- Application means the software program provided by the Company, named Mosaic Habits, that You download onto any Device.
- Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the Application is downloaded.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares or other securities entitled to vote for the election of directors.
- Company (referred to as "the Company", "We", "Us", or "Our") refers to Prachathorn Thanarithiporn ("Peak"), a solo developer based in Bangkok, Thailand, who operates Mosaic Habits.
- Country refers to Thailand.
- Device means any device that can access the Service, such as a computer, a phone, or a tablet.
- Service refers to the Application and this website.
- Terms mean these Terms of Service, which form the entire agreement between You and the Company regarding the use of the Service.
- Third-party Social Media Service means any services or content provided by a third party that may be displayed, included, or made available by the Service.
- You means the individual accessing or using the Service, or the legal entity on whose behalf such individual is accessing or using the Service.
2) Acknowledgment
These are the Terms governing the use of the Service and the agreement between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms, which apply to all users. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of them, You may not use the Service.
You represent that You are at least 13 years old. The Company does not permit those under 13 to use the Service. If You are under the age of majority where You live, You may use the Service only with the involvement and consent of a parent or legal guardian.
Your use of the Service is also conditioned on Your acceptance of and compliance with the Company's Privacy Policy, which describes how We collect, use, and handle Your personal information. Please read it carefully before using the Service.
3) Your account
You can use the app as a guest (your data stays on your device) or create an account to sync across devices. If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorised use.
4) Your content
The habits, notes, and other content you create are yours. You grant us only the limited permission needed to host, store, and sync that content so we can provide the app to you. We do not claim ownership of your content, and we do not use it to train models or sell it.
5) Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- attempt to access accounts or data that are not yours, or interfere with the security or integrity of the Service or its backend;
- reverse engineer, decompile, or attempt to extract source code, except to the extent the law expressly permits;
- resell, rent, or commercially exploit the Service without our written permission.
6) Subscriptions and purchases
Some features may require a paid subscription or one-time purchase. Purchases are billed through the Application Store (processed via RevenueCat) and are subject to that store's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage, cancel, or request refunds for purchases through your Apple or Google account settings — refunds are handled by the store, according to its policy, not directly by us.
7) Lifetime license
If the Application offers a "lifetime" license and You purchase it, that license grants You the right to use the Application in its current state and form as of the date of purchase. "Lifetime" refers to the current availability of the Service and does not guarantee perpetual access. The Company may discontinue, modify, or cease operating the Service at any time. A lifetime license does not entitle You to future updates, new features, or continued server support beyond what is currently provided, and upon discontinuation of the Service the license will terminate.
8) Not medical or professional advice
Mosaic Habits is a personal habit-tracking tool for general wellbeing and motivation. It is not a medical device and does not provide medical, psychological, or other professional advice. Do not rely on it to diagnose, treat, or manage any health condition, and always consult a qualified professional for medical concerns. You use the app and act on your own tracked data at your own discretion.
9) Links to other websites
The Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services, and is not liable for any damage or loss caused by reliance on them. We advise You to read the terms and privacy policies of any third-party sites or services You visit.
10) "As is" and "as available" disclaimer
The Service is provided to You "AS IS" and "AS AVAILABLE", with all faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Company makes no representation that the Service will meet Your requirements, achieve intended results, be compatible with other software, operate without interruption, be error-free, or be free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to You; in that case these exclusions apply to the greatest extent enforceable.
11) Limitation of liability
Notwithstanding any damages You might incur, the entire liability of the Company under any provision of these Terms, and Your exclusive remedy, is limited to the amount actually paid by You through the Service or USD 100 if You have not purchased anything through the Service. To the maximum extent permitted by applicable law, in no event will the Company be liable for any special, incidental, indirect, or consequential damages (including loss of profits or data, business interruption, personal injury, or loss of privacy) arising out of or related to the use of, or inability to use, the Service, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to You; in that case each party's liability is limited to the greatest extent permitted by law.
12) Termination
You may stop using the Service at any time and can delete your account from within the app. We may suspend or terminate Your access immediately, without prior notice, if You breach these Terms or use the Service in a way that could harm other users or our services. Upon termination, Your right to use the Service ceases immediately. Sections that by their nature should survive termination (such as content ownership, disclaimers, and limitation of liability) will continue to apply.
13) Disputes resolution
If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company.
14) For European Union (EU) users
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.
15) United States legal compliance
You represent and warrant that (i) You are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
16) Severability and waiver
If any provision of these Terms is held unenforceable or invalid, it will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force. The failure to exercise a right or require performance of an obligation under these Terms does not affect a party's ability to do so later, and a waiver of any breach is not a waiver of any subsequent breach.
17) Changes to these Terms
We may modify or replace these Terms at any time at our sole discretion. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new terms take effect; what constitutes a material change is determined at our sole discretion. By continuing to use the Service after revisions take effect, You agree to be bound by the updated Terms. If You do not agree to the new terms, please stop using the Service.
18) Governing law
The laws of Thailand, excluding its conflict-of-law rules, govern these Terms and Your use of the Service, and the courts of Bangkok, Thailand will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise. Your use of the Application may also be subject to other local, national, or international laws.
